Terms of service

Purpose

These terms govern access to and use of the FoxPersona service, published by FoxTarget SARL. Creating an account or using the service constitutes unreserved acceptance of them.

Description of the service

FoxPersona turns an email you forward into contact cards. You forward a message to your personal import address; the service extracts the details of the people in it, sends them back to you and makes them available in the application, exportable as vCards and reachable through the API and webhooks.

The service never connects to your mailbox and never accesses it — it only processes the messages you forward.

Account and organisation

An account belongs to an organisation, reachable on a dedicated subdomain. The organisation owner invites members and manages their access and the subscription.

You are responsible for keeping your credentials, your import address and your API keys confidential. API keys can be revoked at any time from the settings, and your import address can be regenerated.

Acceptable use

In case of breach, the service may be suspended, with notice where circumstances allow.

• Only forward messages of which you are a legitimate recipient or sender.
• Do not use the service to build prospecting lists in breach of applicable data protection law.
• Do not transmit unlawful content or infringe the rights of third parties.
• Do not attempt to circumvent quotas, probe or disrupt the infrastructure, or reverse-engineer the service.
• Do not resell access to the service without prior written agreement.

Credits, subscription and billing

Usage is counted in credits. A contact returned to you consumes one credit; a contact FoxPersona fails to extract consumes none. Included credits are reset each period, and additional packs, which do not expire, can be bought at any time.

The applicable prices are those displayed at the time of subscription. Payments are handled by Paddle.com Market Ltd, acting as merchant of record — the invoice is issued by Paddle, which collects any applicable taxes.

The service is for business use only. Prices are displayed excluding tax. Subscriptions are available monthly or yearly; yearly billing is paid in advance for twelve months at the price of eleven. Included quotas remain monthly regardless of billing frequency.

Term, cancellation and deletion

The subscription renews automatically at the selected frequency. An upgrade or a move from monthly to yearly takes effect immediately, with proration calculated by Paddle. A downgrade or a move from yearly to monthly takes effect at the end of the paid period, provided the organization complies with the target plan limits.

Current plan rights remain available until the end of the period, with no pro-rata refund. A scheduled change may be replaced or cancelled until thirty minutes before renewal. If the organization becomes incompatible again before then, the current plan may be kept and renewed.

The subscription may be cancelled from billing settings; it then ends at the close of the current period and does not renew.

After a deletion request, the organisation is deactivated and can be restored for thirty days. After that, its database and files are permanently destroyed. Remember to export your contacts beforehand.

Availability and support

We use reasonable means to keep the service running, without guaranteeing uninterrupted availability. Interruptions for maintenance or fixes may occur.

Intellectual property

The service, its code, its interface and its trademarks remain the exclusive property of FoxTarget SARL. You are granted a personal, non-exclusive and non-transferable right of use for the duration of the subscription.

The data you forward and the contact cards it produces remain yours. They are neither resold nor used to train a model.

Liability

Extraction relies on automated analysis and may contain errors or omissions; it is up to you to check the cards before using them.

The liability of FoxTarget SARL is limited to the amounts paid over the twelve months preceding the triggering event, and indirect damages — loss of revenue, of customers, or of data you hold a copy of — are excluded. None of these limitations applies in case of gross negligence, wilful misconduct or personal injury.

Personal data

The processing of personal data is described in the privacy policy, which forms an integral part of these terms. For the content you forward, your organisation is the controller and FoxTarget SARL acts as a processor.

Changes to these terms

These terms may change along with the service. Any substantial change is notified by email at least thirty days before it takes effect; continued use constitutes acceptance.

Governing law and disputes

These terms are governed by French law. In case of difficulty, please send your claim to help@foxpersona.com first.

If you are a consumer, you may use a consumer mediator or the European online dispute resolution platform free of charge. Failing an amicable settlement, the courts of Lyon have jurisdiction, subject to the mandatory rules protecting consumers.
